Before flavor, before format, before you compare a liquid extract with a capsule bottle, there is one question that decides everything else: can you legally buy kratom at your address? For most American adults the answer is yes. For people in six states it is a firm no, and for some people in otherwise legal states it depends on a county or city line. At Jungle Standard that question is part of the product, not an afterthought. This page sets out exactly how we answer it, state by state and down to the local level.
Federal Law Leaves It to the States
Start at the top. Kratom is not a federally scheduled substance in the United States. No federal statute bans it for adults, which means Washington is not where the real decisions get made. Those happen in state legislatures, county commissions and city councils.
That structure is why national headlines about kratom can be misleading. A story about one state’s vote tells you nothing about the state next door. The only answer that matters to you is the one tied to your own shipping address.
The Six States With a Statewide Ban
Six states currently prohibit kratom across their entire territory. Jungle Standard does not ship any product to them, whether that is a powder pouch, a capsule bottle, a seltzer or a shot:
- Alabama, where kratom is a controlled substance.
- Arkansas
- Indiana
- Rhode Island
- Vermont
- Wisconsin
If your address is in one of these states, the matter is settled for now. We will decline the order, and we would rather lose the sale than put a customer at odds with state law.
When the County Line Matters More
A legal state is not the end of the check. Counties and cities can adopt their own restrictions, and a local rule can be stricter than the state’s. The example most people point to is Sarasota County, Florida: Florida as a whole allows kratom, but Sarasota County restricts it.
Other local governments have passed ordinances of their own at different times, and they do not always make the news. So a clean answer for your state is only half the job. Look up your county and your city as well, because the local rule is the one that applies where you live.
What a KCPA Means for Buyers
A number of states have taken a different route from prohibition. They have passed a Kratom Consumer Protection Act, usually shortened to KCPA. A KCPA keeps kratom legal and then sets standards for labeling, purity and testing.
For a buyer, living in a KCPA state is generally good news. The law pushes vendors toward the habits a serious shop should already have: honest labels and third-party testing. Our lab results page shows what that testing looks like, and our guide to reading a kratom COA walks through what each line on a report means.
Age Rules: Our Line Is 21
Minimum purchase ages vary from state to state. Jungle Standard does not follow the lowest number on the map. We sell to adults 21 and over, everywhere we ship, whatever the local minimum happens to be. That applies equally to a 1 kg powder bag and a single 1 oz shot.
How We Hold the Line at Checkout
Knowing the law is one thing; enforcing it on every order is another. Here is what happens behind the checkout page:
- Geo-restricted shippingWe do not ship to the six banned states, in any format.
- Local rulesOur where we ship page reflects the county and city restrictions we track.
- Adults onlyWe sell to adults 21 and over and no one else.
- Ongoing updatesWhen a law changes, our where we ship page changes with it.
Our where we ship page is the definitive list. If it says we can send an order to your address, that reflects the current law as we track it. If it says we can’t, the order will not go through.
A Map That Keeps Moving
Read any written list, this one included, as a snapshot. Kratom law is still young. Legislatures introduce bills, amend them and sometimes reverse course within a single session, and local measures can appear with little notice. Most of the movement across the states has been toward regulating kratom through a KCPA rather than banning it, but a trend is not a promise for any one state.
The practical habit is a quick check before each order rather than relying on what was true last year. Jungle Standard keeps up with the changes so that the burden sits with the store, not with you. If you live in a banned state and want to follow pending bills, advocacy groups publish state-by-state trackers.
Not Legal Advice
We sell kratom; we are not lawyers. This guide is a plain summary to help you get your bearings, and it is not legal advice. If your situation turns on the precise wording of a local ordinance, confirm it with an official source for your county or city. For questions about an order, our contact page reaches the team.
Frequently Asked Questions
Is kratom illegal anywhere in the United States?
Yes. Six states ban it statewide: Alabama, Arkansas, Indiana, Rhode Island, Vermont and Wisconsin. Some counties and cities in other states also restrict it.
Is kratom banned by the federal government?
No. Kratom is not federally scheduled, so the rules that apply to you come from your state and local government.
Is all of Florida legal for kratom?
Not all of it. Florida permits kratom, but Sarasota County restricts it, which is why we check county and city as well as state.
Do shots and seltzers follow the same shipping rules as powder?
At Jungle Standard, yes. We do not ship any kratom product, in any format, to an address where we cannot legally send it.
Where can I see exactly where you ship?
Our where we ship page lists it and is kept current as laws change. It is the final word on whether we can fill an order to your address.
Jungle Standard products are for adults 21 and over, in states where kratom is legal. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.
